These Terms & Conditions ("Terms") govern your access to and use of the MOTIONS.MY platform, websites, and services (collectively, the "Service") operated by MOTIONS.MY ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.

2. The Service

MOTIONS.MY is an AI marketing video platform that lets you generate scripts, storyboards, and videos using third-party AI providers. Output is generated automatically and may vary in quality. We do not guarantee that generated content is accurate, original, fit for a particular purpose, or free of errors.

3. Credits & Billing

  • The Service operates on a prepaid credit system. Credits are consumed when you generate videos, regenerate scenes, or use paid add-ons.
  • Credit prices, bonuses, and consumption rates are shown in-app and may change. Credits have no cash value and are non-transferable.
  • If a generation fails before it is submitted to the provider, the credits charged for it are refunded to your wallet automatically.
  • Refunds are otherwise governed by our Refund Policy.

4. Your Content

You retain ownership of the briefs, images, logos, and other materials you upload ("Your Content"). You grant us a worldwide, non-exclusive licence to host, process, and transmit Your Content solely to operate the Service — including sending it to third-party AI providers to generate your videos.

You represent that you own or have the rights to Your Content and that it does not infringe any third party's rights.

5. Generated Output

Subject to your compliance with these Terms and the terms of the underlying AI providers, you may use the videos you generate for your lawful marketing purposes. Because AI output may be similar across users and may incorporate provider models, we do not warrant that output is unique or that you obtain exclusive rights to it.

6. Acceptable Use

You agree not to use the Service to create, upload, or distribute content that is unlawful, infringing, defamatory, deceptive, hateful, sexually explicit involving minors, or that violates the policies of our AI providers. You may not reverse-engineer, resell, or abuse the Service, or attempt to access it through unauthorised means.

7. Third-Party Providers

The Service relies on third-party providers (including video and language-model APIs). Your use of generated content may also be subject to those providers' terms. We are not responsible for the availability, accuracy, or actions of third-party services.

8. Intellectual Property

The Service, including its software, design, and trademarks, is owned by MOTIONS.MY and protected by law. These Terms do not grant you any right to our branding except as needed to use the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, MOTIONS.MY will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose.

11. Suspension & Termination

We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us, other users, or third parties. You may stop using the Service at any time.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Malaysia, and any disputes are subject to the exclusive jurisdiction of the Malaysian courts.
